Counter-Notification Procedure

If your content was removed or access was disabled as a result of a DMCA takedown notice, and you believe the removal was a mistake or misidentification, you may submit a counter-notification. This counter-notice also requires specific elements to be valid under the DMCA. Submitting a counter-notice initiates a legal process.

Elements of a Valid Counter-Notification

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of any Federal Judicial District, for any judicial district in which AK2 Magazine may be found. You must also state that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Repeat Infringer Policy

AK2 Magazine maintains a policy regarding the termination of user accounts that are repeat infringers of copyright. We reserve the right to terminate access to our services for any user who repeatedly infringes upon the copyrights of others.
